Intentions: Terms of Use The following are the terms of use for the logos. Turner Investment Partners, Inc. Service Mark Use Policy In order to protect Turner's goodwill and its intellectual property, this policy provides information and guidelines to those entities that desire to use the service marks and logos owned by Turner Investment Partners, Inc. and its affiliates (collectively the "Turner Marks"). Turner may modify this policy from time to time; your continued use of the Turner Marks after such a modification indicates your agreement to those modifications. Notwithstanding anything at the Turner site to the contrary, you authorize Turner to make a record of your acceptance of this policy, including any personal identification information that you provide, as a prerequisite to the use of the Turner Marks. Turner owns federal service mark registrations for TURNER FUNDS (Reg. No. 2924618), TURNER INVESTMENT PARTNERS (Reg. No. 2924617), and PUTTING OUR CLIENTS FIRST (Reg. No. 2669092). Turner also owns service mark rights in other terms, such as TURNER INVESTMENTS. Conditions You may use the Turner Marks in connection with Turner products, services, and programs on your organization's internal materials, provided you observe the following conditions: 1. Except with Turner's prior written permission, you must use the Turner Marks exactly as they appear on the materials provided by Turner. You may not modify or alter the Turner Marks in any way, including size, proportions, colors, elements, type or in any other respect, other than to be enlarged or reduced in overall (proportional) size. 2. When you use a registered Turner Mark in print, you must use the registered trademark symbol ® (for the above listed registered trademarks) with it. If you use the Turner name or logo, you must include in a not inconspicuous location an attribution stating "The name Turner and logo are property of Turner Investment Partners, Inc. and used with Turner's express permission." 3. You may only use the Turner Marks in connection with Turner programs, products, and services and must display them in a manner that confirms Turner's association with and sponsorship of the specific Turner program(s), product(s), and/or service(s) mentioned. You may not use the Turner Marks in any way that tarnishes, blurs or dilutes the Turner Marks or their associated goodwill. 4. Turner reserves the right to review any use of the Turner Marks to ensure that it complies with this policy and trademark law. If you fail to comply with the terms of this policy, Turner may withdraw its permission to use the Turner Marks and pursue any other remedies available to it for improper use of the Turner Marks. 5. You acknowledge that the Turner Marks are owned solely by Turner and/or its affiliates, and that you will not take any action inconsistent with such ownership, such as adopting, using, registering, or attempting to register any logo or trademark confusingly similar to any of the Turner Marks. Your use of the Turner Marks and any goodwill associated with that use will inure to the benefit of Turner. 6. You agree to defend, indemnify, and hold Turner, its principals, affiliates, subsidiaries, shareholders, and their agents, employees, representatives, officers, directors, successors and assigns harmless against any and all claims, losses, liabilities, costs, and expenses, including but not limited to attorneys' fees, arising from any violation of this policy and/or any intellectual property laws.
